There was a motion to accept the minutes of the August 9th 2012 meeting with 1 correction.  The motion was seconded and accepted with a vote of 5-0-0.

GENERAL BUSINESS

Certificate of Compliance:  Residences at Union Place – Upper Union Street
Mr. Bill Yadisernia, Town Engineer, appeared before the Commission to inform them of his findings from the recent site walk he conducted on behalf of the Commission.

Mr. Yadisernia stated that he visited the site on 2 occasions; there are 2 areas of Conservation jurisdiction located there.  On the northern side of the site, there was no stormwater discharge.  The filter fence and haybales are in a state of disrepair.  There was thick growth on the berms of the detention pond.

The detention pond is constructed how it was intended.  

Mr. Yadisernia recommended to the Commission that the owner of the property be informed that this is a detention pond and it needs to be cleaned up as well as the berms need to be cleaned up as well and maintained.

Mr. Yadisernia recommended that a Certificate of Compliance not be issued at tonight’s meeting.

The Commission members agreed to write a letter to the engineer for the site and inform him that  cutting of the overgrowth on the slopes of the detention basin is needed and a maintenance plan for annual brush removal be established.

Public Hearing – Removal of Flood Plain Districts from Conservation Commission Rules & Regulations
The Chair stated that a memo has been received regarding this Flood plain District matter from Beth Dahlstrom, Town Planner.  The Chair informed the Commission members that this past June the Commission added the flood plain regulations to the Conservation Rules and Regulations to establish a flood plain district.  They did this because at the time, the Planning Board and Town Council could not add it to the local zoning bylaws.  Now it is past the deadline for the Town Council and Planning Board to add it to their bylaw and it can be removed from the Conservation Commission Rules and Regulations.

There was a motion to close the public hearing.  The motion was seconded and accepted with a
vote of 5-0-0.

There was a motion to strike Section XX, which is the Flood Plain Districts, from the Con Commission Rules & Regulations.  The motion was seconded and accepted with a vote of 5-0-0.

GENERAL BUSINESS
Discussion:  104 Populatic Street
The Conservation Chair informed the Commission that the applicant appeared at the July 26th meeting regarding an Enforcement Order issued by the Commission.  

An anonymous call was received by the Conservation Dept. alerting them to the fact that the fill has not been removed and the area has not been mulched.  There is presently a car parked in Conservation jurisdiction.  Nothing was done since the Enforcement Order was issued.

A Commission member stated he recently visited the site and found the above to be true and provided photos to attest to this fact.

The Commission members will write a letter to the applicant requesting that he complete the work under the Enforcement Order and  that he appear at the September 20th meeting with photos to show the Commission, what work has been undertaken and provide a progress update with photographs.  He should also be informed that the site is being monitored.

There was a motion to adjourn.  The motion was seconded and accepted with a vote of 5-0-0.  
The meeting adjourned at 7:45 p.m.
